1. Acceptance of These Terms of Service
These Terms of Service (“Terms”) govern your access to, and use of this website and any associated consumer web portal (the “Portal”) operated by Southwood Financial LLC (“we,” “us,” or “our”).
By accessing or using the Portal, creating an account, submitting information, or making a payment, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, do not use the Portal.
Southwood Financial LLC is a debt collector. This is a communication from a debt collector and is an attempt to collect a debt. Any information obtained through the Portal or otherwise will be used for that purpose. By accessing or using the Portal, you acknowledge that Southwood Financial LLC is a debt collector.
2. Purpose of the Portal
The Portal is provided to allow consumers and authorized representatives to:
View account-related information;
Make voluntary payments;
Submit inquiries or documentation;
Communicate electronically regarding an account.
Use of this Portal is not legal advice and does not replace any rights provided under federal or state law.
3. Eligibility and Authorized Use
You may use the Portal only if:
You are the consumer associated with the account, or
You are an authorized representative or attorney acting on behalf of the consumer.
You agree not to:
Access or attempt to access another individual’s account;
Misrepresent your identity or authority;
Use automated tools, bots, or scraping technologies;
Interfere with the Portal’s security or operation.
Unauthorized use may result in suspended access and/or legal action.
4. Account Access and Security
If the portal requires login credentials:
You are responsible for maintaining the confidentiality of your username and password;
You are responsible for all activity conducted under your credentials;
You must notify us promptly of any suspected unauthorized access;
We may suspend or restrict access to protect security, comply with legal requirements, or prevent misuse.
5. Electronic Communications and E-SIGN Consent
By using the Portal, you consent to receive communications electronically, including:
Account information
Payment confirmations
Notices related to Portal use
This consent does not waive your right to receive legally required notices by mail where applicable.
You may withdraw electronic consent or request paper copies by contact us using the information provided on the Portal.
5A. Email Communication Policy and Disclosure
By electing to receive email communications from Southwood Financial LLC, you confirm and agree to the following:
You have read this Email Communication Policy and Disclosure, and you authorize Southwood Financial LLC to communicate with you by email regarding your account(s);
The email address you provided is a personal email address and is not provided by your employer;
By providing a work or government email address, you acknowledge and consent to the receipt of communications from Southwood Financial LLC at that address, and you acknowledge that third parties may have access to those communications. You understand and waive any claims regarding third-party disclosure of such communications;
Only you have access to emails sent to and from the email address you provide;
You agree to take reasonable precautions to protect the confidentiality of email communications with Southwood Financial LLC, which may contain private, sensitive, or confidential information;
To the extent that any third-party disclosure of email communications with Southwood Financial LLC occurs, you consent to such disclosure;
You authorize Southwood Financial LLC to send account-related documents to your authorized email address;
If you make or schedule a payment or payment arrangement before 8AM or after 9PM in your local time zone, and you have consented to receive emails communications, you agree to receive emails related to your Portal activity at or near the time of that activity;
Southwood Financial LLC is not responsible for any delays or failures in the delivery of email communications due to issues with your email service provider or other technical problems beyond our control.
You may opt out of email communications at any time by contact us using the information provided on the Portal.
5B. Test Message Communication Consent Policy and Disclosure
To communicate with you via text message, Southwood Financial LLC requires your consent. By consenting to receive test message communications from Southwood Financial LLC, you confirm and agree to the following:
You have read this text message Communication Consent Policy and Disclosure, and you authorize Southwood Financial LLC to communicate with you by text message regarding your account(s);
By providing your phone number, you are providing consent under the Telephone Consumer Protection Act (“TCPA”) to receive text messages from Southwood Financial LLC about your account;
Message frequency may vary based on your interactions with us;
Standard message and data rates may apply depending on your mobile carrier and plan. You are responsible for any charges incurred for receiving text messages;
The phone number you provide is a personal phone number and is not provided by your employer;
By providing a work or government phone number, you acknowledge and consent to the receipt of communications from Southwood Financial LLC at that number, and you acknowledge that third parties may have access to those communications. You understand and waive any claims regarding third-party disclosure of such communications;
Only you have access to text message communications sent to and from the phone number you provide;
You agree to take reasonable precautions to protect the confidentiality of text message communications with Southwood Financial LLC, which may contain private, sensitive, or confidential information;
To the extent that any third-party disclosure of text message communications with Southwood Financial LLC occurs, you consent to such disclosure;
You authorize Southwood Financial LLC to send account-related communications to your authorized phone number;
If you make or schedule a payment or payment arrangement before 8AM or after 9PM in your local time zone, and you have consented to receive text message communications, you agree to receive text message messages related to your Portal activity at or near the time of that activity;
Southwood Financial LLC is not responsible for any delays or failures in that delivery of text messaged due to issues with your mobile carrier or other technical problems beyond our control
You may opt out of receiving text messages at any time by replying “STOP” to any text message you receive from us or by contacting us using the information provided on the Portal. After opting out, you will receive a confirmation message, and we will cease sending text messages to your number. Opting out may affect your ability to receive certain account related communications;

Your mobile phone number and other personal information will be handled in accordance with our Privacy Policy. We do not sell or share your phone number with third parties except as required by law.
6. Payments and Payment Processing
If you choose to make a payment through the Portal:
Payments are voluntary;
You authorize the selected payment method for the amount you enter;
Payment posting may not be immediate;
Collection activity may continue until payment is successfully processed.
Returned or rejected payments (e.g., NSF or reversals) may result in additional collection activity, subject to applicable law.
Payment processing may be handled by third-party service providers. We are not responsible for third-party service outages beyond our control.
7. ACH and Electronic Payment Authorization
If you authorize an ACH or electronic debit:
You authorize a one-time or recurring debit as disclosed at the time of authorization;
You may revoke authorization by contacting us before the scheduled processing date, subject to applicable rules;
Revocation does not affect obligations already incurred.
Additional ACH terms may apply and will be disclosed separately where required.
8. Disputes, Validation Requests, and Consumer Rights
Use of the Portal is not required to:
Dispute a debt;
Request validation;
Request cessation of communications;
Your statutory rights under federal and state law are not waived by use of this Portal. Instructions for submitting disputes or requests available by contacting us at 888-376-1775 or by email at customerservice@southwood.co.
9. No Waiver or Rights; No Legal Advise
Nothing in these Terms:
Waives any consumer rights under applicable law;
Limits your right to dispute a debt;
Constitutes legal advice.
You may wish to consult an attorney regarding your rights.
10. Accuracy of Information
Information displayed in the Portal is provided for convenience and may not reflect real-time updates. We do not guarantee that all information is always complete or current. Account balances displayed in the Portal may not accurately reflect recent payments due to delays in the receipt, processing, and application of payments, including payments submitted through courts, third-party processors, or other intermediaries. You should contact us directly to confirm your current account balance before relying on Portal displayed information for any purpose.
11. Intellectual Property
All content on the Portal including test, logos, graphics, and software is owned by or licensed to us and protected by law.
You may use the Portal solely for personal, non-commercial purposes related to your account.
12. Prohibited Conduct
You agree not to:
Upload malicious code or harmful content;
Attempt to bypass security controls;
Use the Portal for unlawful or abusive practices.
13. Disclaimer of Warranties
The Portal is provided “as is” and “as available.” We make no warranties regarding uninterrupted access, error-free operation, or suitability for any particular purpose.
14. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Portal.
Nothing in this section limits liability where prohibited by law.
15. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Portal or violations of these Terms, except to the extent caused by our own violation of law.
16. Privacy and Data Security
Your use of the Portal is subject to our Privacy Policy, which explains how we collect, use, and protect personal information. By accessing or using the Portal, you acknowledge that you have read and understand our Privacy Policy.
